A BILL to amend and reenact section ten, article two, chapter
five-a of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, relating to prohibiting the
appropriation of state funds to promote or advertise legal
gaming.
Be it enacted by the Legislature of West Virginia:

That section ten, article two, chapter five-a of the code of
West Virginia, one thousand nine hundred thirty-one, as amended, be
amended and reenacted to read as follows:
ARTICLE 2. FINANCE DIVISION.
§5A-2-10. Powers of secretary in administration of expenditures.

The secretary shall supervise and control the expenditure of
appropriations made by the Legislature excluding those made to the
Legislature and those made to the judicial branch of the state
government. The expenditure of an appropriation made by the Legislature except that made for the Legislature itself and the
judicial branch of state government shall be conditioned upon
compliance by the spending unit with the provisions of this
article. An appropriation made by the Legislature except that made
for the Legislature itself and the judicial branch of state
government shall be expended only in accordance with this article:
Provided, That notwithstanding any provision of this code to the
contrary, no appropriation of state funds may be used to advertise
or otherwise promote legal gaming.

NOTE: The purpose of this bill is to prohibit the
appropriation of state funds for legal gaming.
